Situation Update:

According to an article posted on March 20, 2018, by the Associated Press and NBC Montana, the ban on vaping inside of or around businesses will take effect around April 18, 2018. Business owners will be responsible for placing the appropriate signage and will take up the mantle of low-level policy enforcement.

My thoughts on the topic haven’t changed, and you can see that below this update. Additionally, since businesses are expected to do the low-level enforcement, does that mean any standalone vape shop can run business as usual? Will city officials implement some relocation assistance for any shops unfortunate enough to be located inside a shopping area like Walmart? (Why someone would set up a vape shop inside another retailer is beyond me.)

Another Vape Ban Hammer Drops

Once again I was browsing the web looking for more vape news and discovered an article at GreatFalls Tribune sharing an article from the Associated Press posted February 8th, 2018.

Another U.S. city is under fire from their local officials looking to control vaping under the guise of healthcare, or clean air, or because the sky is blue. Look, if these people took a few minutes to research vaping, they would see just how beneficial it is to their constituents. Anyway, another hammer is scheduled to drop on the vaping community which will ban indoor vaping.

Yeah, I get it…but

As I said in my last Vape Wars post, I am all for banning vaping indoors, so long as it does not hinder vape shops from allowing clients to taste test e-juice within their shops (within reason). In my novice opinion, they could amend the ban to exclude stand-alone vape shops. Meaning any shops located in a shopping center, like Walmart, would need to follow the ban since their place of business exits into another place of business.

If local officials took the time to do the research, instead of blindly believing the crap shoved in their mouths, they would find something like this YouTube video. Check it out.

The Vape Ban Hammer

An article published by DeSoto Times-Tribune claims a vaping ban for the city of Hernando, Mississippi “ignites flap” (Long, R., 2018).

I’m not going to presume I know what the writer means by “ignites flap,” but I will assume it has to do with people in the vaping community getting angry about the ban hammer their local government officials are about to drop in their cloud chasing laps. An indoor vaping ban would ruin revenue streams for every single vape shop, like Mid-South Vapors (3 stores), in the area. One of the most important parts of a successful vape shop is the e-juice. Having a wide variety of e-juice brands, flavors, nicotine strength, and VG/PG ratios goes a long way when it comes to earning a profit.  People want to try different flavors, and a vape shop is a perfect place to taste test something you are not sure you will like.

Yeah, I get it…but come on dude

Listen, I understand there are dumb-asses who will vape indoors where it is obvious vaping should not occur. Those are ignorant people who, like many smokers, will exhale in front of people walking by without a care in the world. People like them are few and far between, and in fact, most of the vaping community work hard to stamp out that type of behavior. So, when it comes to banning indoor vaping in public areas, I’m cool with that, unless that ban includes vape shops. Maybe the solution here would be to move the vape shop located inside a Walmart to a place with exits leading outside. But, to ban indoor vaping at a vape shop is ridiculous.

Vape Shop owners across the U.S. are fed up with the Food & Drug Administration’s 2016 regulations which deemed vape products as tobacco-related and flushed our rights down the toilet like a clump of…well, you get the picture.

Enough is Enough

The Pacific Legal Foundation (PLF) has set three challenges to the FDA on behalf of nine vape businesses in the nation. The challenges focus on how the deeming regulations violate the Appointments Clause of the U.S. Constitution and infringe on the First Amendment of free speech.

According to the PLF, “The power to issue a rule that has the force of law and binds members of the public is reserved under the Constitution only to principal “Officers of the United States,” that is, only people appointed by the President and confirmed by the Senate” (2018)
